Not a happy camper

Unread postby Limey on Wed Jul 04, 2012 1:22 am

Am currently in Nebraska are Lake McConaghay. On Saturday while nearly at the lake we arrived at railroad crossing that had a train passing through. We waited and when the barriers lifted proceeded across. Halfway across the bells started again and the barriers came down. There was another train. Not enough time to get a car across let alone a fifth wheel and boat towing double. The barriers came down again and we made it through - or so we thought.

Later, at the campground, I checked the roof and the barrier had come down on the roof of the fiver ripping the roof at the front, then ripping the roof at the rear and then almost ripping the ladder off the back - it is bent and one roof mount ripped out of the roof.

I have called Union Pacific and recorded a claim for damages. Will keep you posted as to how that goes!

Am travelling back to Colorado in the morning.

What fun - not! Other than that the trip has been great. Will post some pictures when we get home.

Are you leaking? You will have to keep us posted on the damages and what it takes to repair it.

Union Pacific sent me claims forms. Asked for 2 quotes. The first one I got back was for just repairing the roof tears and a new ladder. That was $1100.

The other place recommendsthat the whole roof is replaced. I'll wait to see how much that quote turns out to be! Obviously I would prefer to replace the whole rubber roof, but have doubts that UP will spring for that much!

Will keep you posted.....

Still waiting on final quote.

I got two quotes from the Coachmen dealer.

Roof repair and ladder replacement $1,300; Total roof replacement and ladder repar $8,000. I really doubt that Union Pacific will go for that, so I will probably go with the repair and the new ladder.

Well - I have to say that Union Pacific are now at the bottom of my list for anything you may care to mention. They totally denied my claim and said that their equipment was working correctly, so they see no issue.

The point that they missed (and I repeatedly pointed out) is that although their equipment may go up and down as trains pass quite correctly, the fact that two trains came within 1 minute of each other not leaving me time to cross the tracks meant that the barrier came down on and damaged my ladder and roof. That is irrelevant to them, and after I even threatened legal action against them they said that they were quite willing to go to court and defend. Typical damn big corporation using the 'might is right' attitude and the innocent victim be damned. I have learned a hard lesson here - big business doesn't care about morality and justice.

Now, I have pretty much patched the two tears with Eternabond and have put Dicor around the patches and where the ladder tore off the roof. What I have to do now is buy another ladder and replace the broken one. It really gets my goat that I did absolutely nothing wrong, I obeyed the rules of the road (and the crossing barriers), yet end up being virtually told that I am a liar by a corporate spokeswoman. My DW is a paralegal and her law firm tells us that litigation against a corporate giant like UP is a waste of time, as they will gladly pay out more in legal costs than it would take to fairly compensate me, just so they are shown not to be in the wrong.

I have considered going through my insurance company, but the deductible is more than I want to pay and if I leave it at patching and replacing the laadder, would actually cost me more. So, I have to eat it.

I have, this week, lost a lot of the faith that I had in expecting folks to do the right thing. I never thought I was naive until now.... took me 63 years to get there. :(

Colour me livid!

Then there is the Dave Carrol solution for dealing with a big corporation. https://www.youtube.com/watch?v=5YGc4zOqozo & there are 3 songs. & Dave Carrol has a 2nd career in place - public relations talks about difficult situations.

I kid you not Limey.

Not that I can come up with a theme for your PR effort in this case. I'm just saying one person did an original complaint that affected the company with sincere sympathy.

Well that really does suck! And like you said, trying to take UP to court, good luck. They'll have more lawyers that you could count. :(

A little imagination, what!!

Option A)
Hire Dave Carrol

Option B)
How are you on public relations? Keeping your cook when extremely irate.

{{{Man you should have heard me today. Driving down the highways @ 10 - 15 km over the speed limit screaming very so often to vent my spleen out before speaking with those who didn't do the foul deed. Gladly doing as the innocent suggested and calling the customer service # to tell of the error. I sure didn't sound like the person you'd like to have to give the "how to handle it like a gent talk}}}

I'm so sorry to hear about that dealing with them. Big companies are not easy. They get away with a lot. Once again sorry about that
